Fair Labor Standards Act (FLSA) change
As many of you are aware, a U.S. District Court judge has issued a preliminary injunction to postpone the effective date of the U.S. Department of Labor’s overtime rule. Originally, the rule was to go into effect on Dec. 1.
Since the ruling, the Board of Regents of the University System of Georgia (USG) has maintained consistent communication with the Governor’s Office and the Attorney General’s Office on the next steps related to initial Fair Labor Standards Act (FLSA) changes at Georgia State and other USG institutions.
We have been advised that any FLSA-related salary change will remain in effect. Employees whose salaries were to be raised to the salary threshold will still get that increase. While some of those employees have been informed, we will send a confirmation email in the next few days.
For now, employees who were reclassified from exempt to non-exempt will continue to track their time in the ADP system. The University System Office has informed us no additional action will be taken until a thorough analysis can be conducted. The System Office will work with each institution to determine a system-wide strategy on how these matters should be handled.
Georgia State’s Human Resources Department will keep you informed as these changes are communicated to us and as further developments occur.
